Privacy Policy for Personal Data
This Privacy Policy for personal data (hereinafter referred to as the Privacy Policy) is a public Agreement concluded between the owner of the Online Store, Limited Liability Partnership "Chupa.kz" (Seller) and the Buyer in accordance with Article 387 of the Civil Code of the Republic of Kazakhstan, is based on the Law of the Republic of Kazakhstan "On personal data and their protection", applies to information containing personal data of Buyers, which the Online Store http:// www. с hupa . kz (hereinafter referred to as the Online Store) may receive about Buyers during their use of the Online Store website.
1. Definition of terms
1.1. Personal data - information related to a specific or determinable subject of personal data, recorded on electronic, paper and (or) other tangible media.
1.2. Non-personal data - information that is automatically transmitted during the Buyer's viewing of advertising blocks and when visiting pages on which the system's statistical script is installed: the address of the requested page, cookie information, IP address, browser information, referrer (address of the previous page), access time.
1.3. Collection of personal data - actions aimed at obtaining personal data.
1.4. Processing of personal data - actions aimed at accumulation, storage, modification, supplementation, use, distribution, depersonalization, blocking and destruction of personal data.
1.5. Protection of personal data is a set of measures, including legal, organizational and technical, implemented for the purposes established by the Law of the Republic of Kazakhstan "On personal data and their protection".
1.6. Online store - an Internet site located on a server in Astana and having the Internet address http://www.сhupa.kz, which presents the goods offered to Buyers for placing Orders, as well as the terms of payment and delivery of these Orders to Buyers.
1.7. Website Services – all services available for use on the website http://www.сhupa.kz and subdomains.
1.8. Buyer – user of the Online Store.
1.9. Seller – Limited Liability Partnership “Chupa.kz”, which is the owner of the Online Store, BIN 241240021289 .
1.10. Cookies are small text files in which the browser records data from the websites visited by Buyers. Cookies perform a number of functions, for example, they allow the Buyer to move between pages efficiently, remembering their preferences, and thus improving the experience of interaction with the Internet site. They can also help ensure that the advertising that the Buyer sees online corresponds to their interests. If you do not use cookies, it will not be possible to buy a product in the online store at all, since the entire operation of the shopping cart is based on saving data from these files. For example, if the Buyer selects a product in the online store, puts it in the shopping cart and goes to a new page, this product will simply not be saved in the shopping cart.
1.11. IP address — a unique network address of a node in a computer network built using the IP protocol, allowing the location of the Buyer to be determined. The online store does not track the location, in more detail than the city and region.
2. Subject of the privacy policy
2.1. This Privacy Policy sets forth the Seller's obligations to maintain confidentiality and ensure the protection of the privacy of personal data that the Buyer provides at the Seller's request when registering on the website of the Online Store and/or when placing an order to purchase a product.
2.2. Personal data permitted for processing within the framework of this Privacy Policy are provided by the Buyer by filling out the registration form on the website of the Online Store and include the following information:
2.2.1. the Buyer’s last name, first name, patronymic (patronymic – optional);
2.2.2. Buyer's contact telephone number;
2.2.3. e-mail address;
2.2.4. delivery address of the Goods.
2.3. Any other personal information not specified above (purchase history, browsers and operating systems used, etc.) is also subject to secure storage and non-dissemination, except for cases provided in paragraph 4.3.2. and paragraph 4.4. of this Privacy Policy.
3. Purposes of collecting and processing personal data of Buyers
3.1. The Seller collects, processes and stores only those personal data that are necessary for the provision of Services and/or the purchase of Goods by the Buyer from the Online Store catalogue.
3.2. The Seller uses the Buyer’s personal data for the following purposes:
3.2.1. identification of the Buyer for placing an order and/or concluding a Contract for the sale and purchase of goods;
3.2.2. processing and receiving payments from the Buyer;
3.2.3. delivery of goods to the Buyer;
3.2.4. providing the Buyer with effective customer support;
3.2.5. providing the Buyer with personalized Services;
3.2.6. communications with the Buyer, including sending notifications, requests and information regarding the use of the Services, provision of services, as well as processing requests and applications from the Buyer;
3.2.7. improving the quality of the Services, the convenience of their use, developing new Services;
3.2.8. informing the Buyer about ongoing events and promotions;
3.2.9. conducting statistical and other research based on non-personal data, as well as optimizing advertising messages.
3.3. The Seller shall not be liable for information provided by the Buyer on the website in a publicly accessible form.
3.4. The Seller shall not be liable for any losses that the Buyer may incur as a result of his login and password becoming known to a third party.
4. Rights and obligations of the parties
4.1. The Buyer is obliged to:
4.1.1. provide information about personal data necessary for using the Online Store;
4.1.2. change or supplement the information provided if incorrect data is discovered while using the Online Store.
4.2. The Buyer has the right:
4.2.1. to access and edit information about personal data at any time through the web interface provided within the services.
4.3. The Seller is obliged to:
4.3.1. use the information received solely for the purposes specified in Section 3 of this Privacy Policy;
4.3.2. ensure that confidential information is kept secret, and not disclose the transferred personal data without the prior written permission of the Buyer, with the exception of the transfer of data for the purpose of fulfilling the Buyer’s order (to courier services, postal organizations, banks, etc.), as well as to authorized state bodies of the Republic of Kazakhstan in the manner established by the legislation of the Republic of Kazakhstan;
4.3.3. take precautions to protect the confidentiality of the Buyer's personal data in accordance with the procedure generally used to protect such information.
4.4. The Seller has the right to provide access for collection and analysis of non-personal data of Buyers to third parties for statistical purposes and optimization of advertising messages. The use of non-personal data by third parties is governed by their own privacy policies, and the Online Store is not responsible for their use.
5. Other conditions
5.1. The Buyer’s use of the Online Store means his/her unconditional consent to this Privacy Policy and the terms of processing of the Buyer’s personal data by the Seller.
5.2. In case of disagreement with the terms of the Privacy Policy, the Buyer must stop using the Site and the Online Store.
5.3. This Privacy Policy applies only to the website of the Online Store http://www. chupa .kz and subdomains. The Online Store is not responsible for third-party websites that the Buyer may access via links available on the website of the Online Store.
5.4. Due to the specific nature of the method of obtaining information, the Seller does not verify the authenticity of the personal data provided by the Buyer and does not monitor their relevance. However, the Seller assumes that the Buyer provides accurate personal data and keeps this data up to date. The Buyer bears all responsibility, as well as possible consequences for providing inaccurate or outdated personal data.
5.5. Disabling Cookies may result in the inability to access parts of the Online Store website that require authorization.
5.6. The online store collects statistics on the IP addresses of its Buyers. This information is used to identify and resolve technical problems, to control the legality of financial payments.
5.7. The current legislation of the Republic of Kazakhstan shall apply to this Privacy Policy and the relations between the Buyer and the Seller.
5.8. The Seller reserves the right to unilaterally change this Privacy Policy to further improve the security system in accordance with the current legislation of the Republic of Kazakhstan.

5.10. The Seller shall not be liable for the actions of third parties who have gained access to information about the Buyer as a result of using the Internet, or for the consequences of using information that is available to any Internet user.
